Dear Nalini,
I hope this is regarding the furniture showroom. Are the carpenters on the company payroll, contract basis, or paid daily wages?
For those on the company payroll, they should be treated like other sales staff.
Regarding contract workers, the contractor will manage their replacements in case of absence.
As for those paid daily wages, a day off should suffice for 6 working days. If they take additional leave, you can deduct their salary accordingly.
Thank you.

We are an Engineering Company with a team of 20 members:

The pay structure for staff is as follows:

- HRA: 15%
- Local conveyance: 15%
- Other allowances: 30%
The salary range is Rs. 10,000 to Rs. 40,000.

Dear Nalini,
You can go with the following breakdown:
- Basic + DA = 60%
- HRA = 20%
- Conveyance = 10%
- Medical/Other allowance = 10%
I hope your organization is growing. Regarding ESI, I understand that the ESI Department is considering changing the minimum employee requirement from 20 to 10, which might come into effect in 1-3 months. Under the PF Act, if your salary range is between 10,000 - 40,000, you might have only the minimum number of employees for contribution. Many employees may have a basic salary above 6,500, where you can either get an exemption from PF contribution or contribute a maximum of Rs. 780.
Alternatively, you could consider the following structure:
- Basic = 50%
- HRA = 30%
- Conveyance = 10%
- Medical/Special allowance = 10%

Hi Shenbagarajan,
That was valuable information. As per the TN Shops & Establishment Act, the EL entitlement is 12 days, which can be accumulated to 24 days.
Please let me know if my leave exceeds 24 days, for example, 28 days in the 3rd year of my service. Will the company have to pay for the remaining 4 days, or will they be lapsed?
Kindly also specify the rule or section where I can find this information in the TN Shops & Establishment Act.

Dear San,
You can accumulate earned leave (EL) for a maximum of 90 days. Today's scenario varies from company to company. Some companies will credit 30 days in advance at the start of the year and will carry forward 15 days to the next year if the leave balance is more than 15 days. Any other remaining leave will lapse. In the following year, 30 days will be added to the 15 days.
30 days of earned leave is derived from 2.5 days per month. For more details on the rules, please refer to the first page of the TN S & E Act manual soft copy.
Thank you.

Dear Manjula,
You can apply form VA to the respective DIL/LI in your circle. Since you are an online retailer, your warehouse has to be registered only in the Shops and Establishment Act.
"Shop" means any premises where goods are sold either by retail or wholesale, or where services are rendered to customers. It includes an office, a storeroom, godown, warehouse, or workplace used in connection with such trade or business. However, it does not include a factory or a commercial establishment.

Dear Mr. Dipil Kumar V,
In case you have not got clarity on this registration part in Tamil Nadu, we would like to clarify that it is not required to obtain a registration certificate under the TN Shops & Establishment Act, and there are no official formalities to do so. Instead, each establishment must obtain formal approval from the authority under the TN Industrial Establishments (National & Festival Holidays) Act, 1958. This approval is known as the "Festival Holidays Approval."
In the context of Tamil Nadu, this approval is considered a Certificate of Registration and is mandatory to obtain. Please feel free to write to us if you need any further clarification.
Thank you.

Dear Mr. Govind,
No provision is made for the number of employees under the Tamil Nadu Shops and Establishment Act. This Act applies even if you have only one employee in your establishment. However, you may be exempt from submitting returns and maintaining registers based on your establishment's employee count. There is a provision in "The Labour Laws (Exemption from furnishing Returns and Maintaining Registers by Certain Establishments) Act, 1988."
Please let me know if you need further clarification or assistance.
Thank you.
