Before the issuance of a notification for the enhancement of the wage ceiling, the Central Government is required to issue a notification of its intention to amend the present provisions of the wage ceiling as per Section 95 of the ESI Act, 1948. It appears that the said notification of intention has not been issued so far. The exact position can be ascertained from the appropriate Regional Office of the ESIC.

I do not think that intentional notification and calling for objections against the proposed rule amendment is necessary under Section 95 of the ESI Act. What is required is a previous publication in the official Gazette of the Union of India (Subsection 3).

When the last enhancement in the wage ceiling was made in the year 2010 with effect from 01/05/2010, the draft intention notification dated 26/02/2010 was published in the Gazette of India Part-II, Section - 3, sub-section 1, Extraordinary, dated 27/02/2010.
I hope, if I am not mistaken, you may confirm the same from the appropriate office of ESIC if desired otherwise.

I checked the final notification issued in April 2010, which refers to the initial notification dated February 2010 and the objections received and disposed of when the wage limit was increased to Rs. 15,000 w.e.f. 1.5.2010. I stand corrected and appreciate your timely intervention.
Therefore, we need to wait for the initial notification, followed by a final notification, with at least a clear 30-day notice period. The increase in the wage ceiling may only occur in the new year.
