Since Factory Manager and Personnel Manager are holding the post and are responsible for the day today affairs of the company.Person holding post is responsible for the decision/s taken during his tenure.Therefore, complaint is filed against person not agaist the post. Even in case they resign they will have to appear before the court as and when the date for hearing is fixed by the court. Even in case of absenc on date of hearing ,In case of criminal complaint, if they remain absent in the court, Judge may order to issue non bailable warrant against them.
