A new never does anything wih bad intention. It is in general that one believes in " First impression is last impression" . Though some times it hits back as in same case. But HR should always take responsibilites of his/he juniors to make him/her understand to avoid such kind of termination.. HR should have definately opposed to MD for this early termination or should have asked some times (15-30) days to seek him another job. As long as HR Seniors would keep tolerating every unethical/unfair practices how can they do justice to their employees. After all HR is an inbetween link to Management & workman and everyone has a lot of expectation to them. So, please be a good judge and try to find out the best ways possible.

That's right, labour court can be approached for worker category only. but if we know the company, we can caution the job seekers so that the company finds it difficult to find a new recruit and also we can save someone else from falling in to their trap.

I also faced The same situation,few months back.But in my case the employer is politely explaining his financial crisis and told me to relieve.But the same time he told that i will call you after few months, that time you can come and rejoin.But i refused that.
Come to your issue.I agree that you are cheated.If you won the case against them,do you think the organization will treat you good? I think know.If possible talk to the management, if they not responding you,then file case against them. If you won the case don't join the company again.At least after this issue, they should concentrate more in recruitment.

your past records of previous employment.
your acedemic fulfillments etc.

Filing case will not yield any positive result. As Management do not want you there simply leave the job and search for another one. Lot of options are available in Market. Do not worry keep your head / moral high.
Small companies do this, having good HRD policy is not a easy task. Sometimes it happens in small organisation, which is not at all good but you can not help them, they go at their own.
Be positive you may get better chance. Good luck.

this is a case of breach of contract of service, being an HR your employment terms & conditions are governed by the agreement executed btween you and the so called company. once company offer you you accepted the offer, it became a valid contract. you can go for the enforcment for breach of contract and damages caused to you before the civil court. For this appointment letter is not required offer letter and acceptance of offer letter is sufficient to conclude the agreement. Appointment letter is the general terms & Conditions.
On the other hand it's a matter of joh respoinsiblity which can define whether you are falling under the category of workman or not, designation have nothing to do with it. i will advise you to try to convince the employer, if not ready then go to labour commissioner or civil suit. Civil suit is a lengthy process.

Apart from what Mr. HIMANSHU PARMAR has stated, please see if ID Card was issued to you by the Company and if any e-profile (e-mail etc) was made and if do have any record of those E-mails. Have you signed any documents/Registers in the company which could prove your joining and working there. Do you have the envelop in which the offer letter came to you. Was it Registered Post or through Courier. Try to obtain the PoD. Were the marching order given to you in writing or was a verbal sermon?
All this record can be summoned in the court to prove you actually worked.

I am not a HR but a S/W person. I found this site very informative and so have joined it.
Each and every company does this kind of sacking. It is the manager who does it. Not the company. I decided not to pamper my boss and so I was shown the door though the company's HR policy says nobody should be sacked. I was forced to resign by the HR illegally !!!
Infact they went on to the extent of saying that I was psychatric patient. With great difficulty, my Dr. has finally convinced my family that I am not. Imagine the torture for 3 long years !

Is he having some family dispute as a result some family member or relative had approached / pressurised the new co. to take such action.
