You dont need to fear about the threat given by HR.
Secondly, it looks like your manager is playing a dual game. 99% of organisations go by manager's terms, there is no second reference to check, and if that was the case your manager should have done this before commenting on the waiver.
Pls leave all this behind and peacefully pursue a career with a better firm. Incase of any phone calls or emails from HR you just let then know that you are not intended to pay them anything and incase of any action threat by them, let then know that you would like also to approach labour court for their apathetic behaviour.

Do one think attach those mails and send it back to the HR dept. Stating that if they try to threaten you again u will file a case against them..
As it is you report in to your boss and he has granted you the waive of notice period..and state that he was absolutely fine with it..and the HR deept. as well did nt speak to you abt this
U threaten them back that the HR dept did nt bring it to ur notice during Exit Interview..

Have u given 90 days notice in your resignation letter? If you have given the notice and the company is relieving u before that u no need to pay any amount in lieu of notice period.

If he has given the 90 days notice. Then surely he will not be liable to pay 78 days notice amount but what about the management? Will management pay 78 days notice amount if management relieved him in 12 days?

I have given 12 days notice with my head of dept approval. I also handed over all my work in 8 days and i sat for 3 days with no work in the company. Till that time there was nothing against me about notice period and my head of dept also sent an email by writing that i am going through financial crisis and i should be given notice waiver as a special case.

Before my leaving from the company, i didn't get any f&f or any rejection letter of my notice period. They sent me rejection of notice period after i left the job.

The HR had spoken very badly to me before my leaving and he told me to meet him, but the way he spoke to me ..i prefer not to meet him.

His words were not only rude but hampering my dignity and self pride. His words made me cry in the office infront of everyone.

I didn't understand why he behaved with me like that but the words which he told me were very personal which can be shared by my boss with him only. My boss played a dual game at the end with me.

I verbally told the management representative that i will not able to pay my notice period because of my financial reasons. Also i am not meeting HR person becoz of his bad behaviour with me. .....

His reply was...don't give money....what they will do.. nothing....But when i called him now..he said, its a company policy..

You went in only one direction without anticipating the results. In this present world, there is no chance of accepting oral communication system. In connection to your case, i strongly suggest you to pay the salary (78 days) because this is a small world and your present company (if u have joined) may be feel of this. Going in 12 days is a very big mistake of you. Minimum you have to work for one month if your notice period is more than two months. So, do not make it complicate. Once you again meet the head of the dept or head of the organisation (MD or other top mgt) and explain the genuine reasons for leaving the organisation.
If I am wrong, leave it.

I agree, but when i resigned i have told my boss that i want to leave on this particualrs day (which was the 12th day of my notice period), if u are agree only...then i will write it into resignation. He said ..he is ok...the same day i resigned in written...he gave his no objection approval..by writing he has no oabjection if i leave on.... and sent to hr. Not only that he has also written to HR to waive off my notice period.
I have everything in written....They have not stopped to work there...they are just telling me to pay the money. I was ready to work for 30 days also but they told me this thing when i joined the other (new) organisation.
My new employer also knows this thing...as i have not get the reliving letter from the previous employer.
I was reporting to my head of the dept..and he has given me no objection ....that was sufficient for my present employer.

yes, there are similar instances with me also, Inspite of working for 13 years in various departments at a senior position for a Glazed tile manufacturing company and repeated requests to waive off my notice period dues, management was reluctant and a huge sum of money was deducted during the Final settlement, this has become pathetic these days, i dont know which is the forum which can address these kind of problems

infact working for long time does not entitle u for a waiver i notice period. if u look at this case this is purely a special case. However i agree companies are getting worse day by date in reliving employees and all that stuff..

I agree with Rajesh that most companies would not go legal on this issue, especially as courts usually rule in favour of the employee.
However you need to be certain of one thing: Was there any written communication to you , before your last working day, that the waiver recommendation of your manager has not been accepted, and that you would have to serve complete notice period ?
In my opinion, reporting manager can only recomend a waiver, the final decision is with HR/ management.
