Gratuity Act will cover to establishments, in which ten or more employees are employed, or were employed, or, any day of the preceding twelve months, as the Central Government may, by notification, specify in this behalf.
Gratuity is payable after separation/ termination of his employment of employee (superannuation, retirement or resignation & death or disablement due to accident or disease) after he has rendered continuous service for not less than five years.
Subject to the provisions of sub-section (2), Employer is to obtain an insurance in the manner prescribed, for his liability for payment towards the gratuity under this Act, from the Life Insurance Corporation of India established under the Life Insurance Corporation of India Act, 1956 (31 of 1956) or any other prescribed insurer.
Since there is no question where employer can say he is paying gratuity in monthly part.
