Hi All,
I wanted to check if we make any hires towards Internships or trainees in our organisation, then would we still need to follow the new ESIC rules of minimum of 21000 INR. The interns or trainees are still pursuing their education and are yet not graduates from the respective colleges. Also they need to stay here for internship only for 2 or 3 months.
Please help

Sir, under provisions of ESI Act, 1948 (definition of term "employee"), only the apprentices engaged under provisions of the Apprenticeship Act, 1961 are not coverable under said Act and that too for the only specified period as mentioned in the Apprenticeship Act. If not engaged under provisions of said Act, all persons so engaged, whatsoever, the intention and purpose may be, are coverable under provisions of ESI Act, 1948.
