ESI Act, is not mandatory to adhere to by all The Commercial Establishments, becuase, there are certain areas which are not covered by the ESI Organization. Area coverage is also an exemption to get relieved from ESI Act. The Gazette Notification is to be observed and your area ESI Department Enforcement Officer is the right person to get in touch. At times, Citeman friends' advices may differ from the department officials advice.
Pl. check up and ensure with the concerned ESI official/s, otherwise, they do the things differently.

Pl.check if Silvasa is notified area under ESI ACt.IF not, units in that area will not be covered under the Act. Jagdish Patel

Please visit the ESI official web site <link outdated-removed> where in you will find all the benefits available to the insured persons and responsibilities and duties of employers who are covered under the Act

In your payroll no body is under ESI and you are not covered under ESI. Now the 3 cont labour is working as a permanent nature still they are covered under ESI. Because for ESI coverage total strength will be counted irrespective of he is covered or not hence if the total strtength is 10 or more your factory is covered where may be one employees is getting less than 15000/-

Where there is no ESI facility at that area W/C is applicble. But the benefits of W/C is not same like ESIC.
