Mr. keshav Korgaonkar has rightly said that it is mandatory to pay HRA to employees in those States like Maharastra where there is a Statute on minimum HRA payable is in vogue. I too concur with him that all States may not have enacted Acts simiilar to the one in Maharastra. It is a State Act. Other members can chip in with information on this.
So far as the definition of 'Wages' under the MinimumWages Act is concerned, it includes HRA also as Mr. Hemant Kondhalkar said.

I do agree with you. In fact I referred the definition on posting of Saikumar ji. Otherwise I was under wrong conception. Thanks to you. Thanks to Saikumar ji.
I do not agree with you that the HRA is compulsory to pay since it is included in the definition of wages under MW Act. What does the definition mean, if you pay HRA then it is a wages.

Minimum wages notified by each state has two components - basic and DA. In some states, instead of da, they notify special allowance. Nowhere in the minimum wages notification is hra notified or made mandatory. As Mr. KK said, Maharashtra and Gujarat has a separate legislation where minimum HRA component of 5% of basic + DA Is required to be given. I was not aware that West Bengal has same rules.
However, in no other state is hra a part of minimum wages or mandatory under the labour laws

HRA or house rent allowance is applicable in all states of India but what differ is the % as in metros it is 50% of the basic and in other cities it goes to 40% of the basic.

I think couvert, you are talking of hra as allowed deduction under income tax act The original post (as far a can figure) is related to compulsory payment of hra under the labour laws

(h) “wages” means all remuneration capable of being expressed in terms of money which would if the terms of the contract of employment express or implied were fulfilled be payable to a person employed in respect of his employment or of work done in such employment and includes house rent allowance but does not include -
(i) the value of -
(a) any house accommodation supply of light water medical attendance or
(b) any other amenity or any service excluded by general or special order of the appropriate government;
(ii) any contribution paid by the employer to any person fund or provident fund or under any scheme of social insurance;
(iii) any traveling allowance or the value of any traveling concession;
(iv) any sum paid to the person employed to defray special expenses entailed on him by the nature of his employment; or
(v) any gratuity payable on discharge;

Good morning everyone,
Could anyone please clarify, to which states in India HRA component in mandatory in the minimum wages for contract labor under shops and establishment act. Please mention the minimum & maximum percentage HRA to paid on BASIC+DA. Is there any law to pay HRA compulsorily in states like Maharashtra, Gujarat & Kolkata. If possible could you please attach the supporting documents.

Is it compulsory to add HRA in salary or wages for Gujrat or Tamilnadu ?
