My query is, lets say an employee has served 5 yrs and 2 months. Suppose that in any year of while serving he did not worked 240 days. he was a habitual absentee due to that in any calender year he did not performed 240 days during 5.2 years of his total service period.
in that case, is he entitled to get gratuity?
please justify it.

Pls. go through the Payment of Gratuity Act 1972, and See Sec.2A (Continuous Service). There you will get clear solution for your query. Because you are in the scene and you know well about the situation, the act gives the way to calculate gratuity for different situation. So better go through the same and it would help you to get clearance.

Yes the employer has a right to stop the employee's gratuity. Gratuity is nothing but a gift to the employee from the employer for his honest and diligent work for more than five years.
But you need to figure out that it was a case of misconduct and employee was found guilty and the decision of the management is not biased.
