Greetings for the day,
Since you stated that employee has resigned and withdraw his epf accumulations & obtained scheme certificate from epfo ,he once again joined in the xyz organization. This means he has started his new job. You have to open his new epfo account and also ask him to transfer his/her eps accumulation in the new epf/eps a/c by simply filling form-11 and surrendered the scheme certificate with the form 11.

Need help in ascertaining which formula is right in calculating Yearly Bonus and Payment / Encasement of Earned Leave. Serial Number 1 OR 2.
Bonus Formula:-
1 =(D7+D8)*8.33%
2 =(E7+E8)*8.33%+(((E7+E8)*8.33%)*1.75/30)
Earned Leave :-
1 - =SUM(D6/30)*21/12
2 =(SUM(E6+SUM(E20:E23))/30*21/12)+(((SUM(E6+SUM(E20:E23))/30)*1.75)*1.75/30).
For your information one of Contractor is asking to pay the same on Formula at Serial Number 2, Previous Contractor were asking as per Formula Number 1.
Formula 1 Consist of Gross Salary while 2 Consist of Gross Salary Plus earned leave per month as per Bombay Shops Act

Can we appoint an employee after next day of his superannuation? Would he be necessary to give PF and Gratuity benefits during re-employment? Appointment would be for a year and on regular rolls.

if he is already a PF pensioner or has withdrawn his PF accumulations on his attaining the age of superannuation he can be excluded from EPF

I may repeat Mr. Bhalai's words. PF accounts are not perpetual accounts in terms of withdrawals and deposits, Like we do with our Savings bank account. Once the subscriber withdraws his / her name from his / her establishment's PF code, the account became inactive and is non transferable as well. that means you cant transfer one account code to two employee.
