Dear Gangwal ji, thanks for writing me as above and to inform that the appropriate government has already issued notification in July, 2016 extending the operation of said Act to all areas of some Districts of Maharashtra ( where scheme was already implemented) w.e.f. 01/08/2016. If the area where your unit is located falls in any of such Districts as mentioned in notification and employ minimum numbers of persons as per said Act, then definitely, in my opinion, your unit is covered or coverable under ESI Act, 1948 and rules/regulations framed thereunder. You can confirm the position from nearest ESIC Office or from Sub-Regional Office, ESIC, Pune.
2. Further, some of experts/seniors who are contributing in this HRcite viz. S/Sh. Korgaonkar ji, and Kulkarni ji are I think, are based in Maharashtra and you can seek their opinion, if desired. Both of these seniors have indicated their views in this thread also.

As per the post for ESIC in Tarapur , You said Tarapur Industrial & manufacturer association (TIMA) has challenged the implementation in High court as there is no facility in the palghar district and also no panel hospital or dispensary . Please let me know what is the outcome from High court . whether TIMA lost the case in High court or it is still stand. Many contractors are facing lot of problems as there is no facility in Tarapur/Palghar/Dahanu - MIDC and NO ESIC registered doctors/dispensary .We heard that registered doctors send the patient to mumbai and do not treat. it is a live case of "Tuglaki farman" from Labour ministry. Hope to get the ESIC Implemented soon with the Hospital paneled with ESIC to justify for employees who actually need the facility in palghar and other districts which does not have facilities.
