From your narration it is discernible that you are still an employee under orders of transfer from Kanpur to Chennai as you haven't so far complied with the transfer orders and no orders of suspension given by the management. As such how can you claim subsistence allowance for the period of absence caused out and out by your refusal to join at the trasferred station?

Lucky ur getting half salary..in my case i am working psu as AGM..company transferred me to other department against the purpose of appointment to remote area where company do not have any established set up..asked me work as attender(lowest position in department) with due respect to company having worked..for last 18 months..irrespective of many request
They r forceing to continue in same work..now i have refused to work in inferior designation.. For the last 4 months no salay..just reciveing threatened letters..hell in psu cos.
If u go to court they lot of public money to buy the law.

Dear Anonymous, From your post, I understand that domestic enquiry completed ion Dec.14, but you are not given salary from much before and after concluding enquiry, no disciplinay action was imposed during past 7 months. If i is correct, then your action od raising indl. dispute will be immature and illegal. You should raise your claim before management demanding suspension allowance. Not paying suspension is violation of principle of natural justice hence domestic enquiry process will be illegal. Refer Foolabhal SolankiVs Alembic Chemical case.

Dear friend,
It appears from what you said, you are not yet been suspended pending inquiry. Which means you are still in service and hence you are not eligible for payment of subsistence allow but full salary. For non-payment of salary ofcourse you have a right to demand and so you should send a regd. letter to your CEO/HR to release your salary with over due interest and also file a petition with jurisdictional Labourt Inspector/Dept. at Chennai. If they are not taking any action you should file a writ petition at Madras High Court itself for early hearing by an appropriate authority and payment of salary. Before that you should ensure what is your status and you have all your documents with you. You cannot afford to keep quiet. How will you eat and survive without salary at Kanpur or Chennai ? Do you really execute some work at Chennai or simply asked to sit and go ? You should move the matter with the advice of an Advocate and to fast track your case.

Sir..Since last 7 months they have not conducted enquiry not suspended.
Match-14 salary along with bonus & leave encashment was paid in dec-15.
Gratuity amount was paid on 30 the dec-15.
Since 7 moths they are just sending letters to work in Guwathi as medical rep ( by qualification mechanical engineer employed as AGM-PROJECTS in yr 2007)
I was depressed a lot about my career bcoz in job market now I a medical representative.
