If any employee is taking sick leave and he is under ESI then private hospital medical certificate should be acceptable by employee when he will resume his duty .We need your feedback information plz all.

If an employee is covered under ESI, then he is supposed to approach ESI Hospital/Authorities and all benefits viz medical treatment, payment in lieu of leave, compensation etc are payable by the ESI authorities and management has nothing to pay on this count to the employees. IP will submit Medical Certificate and Fitness Certificate as issued by the ESI doctor to you.
Private Hospitalization is only applicable if ESI Hospital recommends. Plz note Medical Leave is payable by the ESI to the IP as per their rules and no medical leave is payable by the company. After all managements contribute their share @ 4.75% in comparison to employee share @ 1.75%

Dear Gupta, You give me so good information regarding this, But he not taking esi benefits. He has many leave balance, can we give this leave behalf private medical certificate, Regards Gaurav Mehta

Dear Mehta You can give him any kind of leave but not Sick Leave as this kind of leave is not admissible to ESI Covered employees. OK V K Gupta

some time i found many organization demand medical certificate after 3 days sick leave from employee whether under esi or not, This certificate not from esi all time some time private hospital medical certificate submitted from employee, this leave should be sanction or not plz sir clear my dought.

"61. Bar of benefits under other enactments. — When a person is entitled to any of the benefits provided by this Act, he shall not be entitled to receive any similar benefit admissible under the provisions of any other enactment."
