Thanks for the Feed back but the Question is remaining here that if Gratuity paid limit is 10 Lakhs then what about the remaining balance that is more than 10 Lakhs...... For example an employee's total gratuity amount is 13 Lakhs in that cash what about the rest 3 Lakhs
Will company pay the rest amount or it would be laps.
If company will pay than how????

Payment of Gratuity Act is normative legislation, therefore entire gratuity above Rs. 10 L can be paid. But there are I Tax angles. The employee will have to IT on amount over Rs.10 L and employer may not be allowed to show payment beyond Rs. 10 L as business expense.
