Hello Everybody,
I would like to know whether is it mandatory to form the SHP Comittee in a Company even though there are no female employees employed? The said Company is Located in Gujarat and has no Female employees while all the employees are Men only. So is the Company Managemnet bound by the The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 ("Sexual Harassment Act")? Please friends enlighten me on the subject ASAP.

Answer to the first question, I agree with mr. Yadav. No need to form a committee under prevention of sexual harassment act
However do not think your company is not bound by the law. The act covers not only sexual harassment of women employees but you are required to make sure that even women contract employees, vendors and visitors are protected. Therefor sensitisation of the male employees to what is sexual harassment is still a requirement

Dear Mr. Harish Mody, Technically, the POSH law provides that "every organization having 10 or more employees" has to comply with it. Therefore, it is applicable to your organization.

Hi All,
I agree with Mr. Harish Mody. The Act says 10 or more employee. It has not distinguished between female or male Employee. In this context it is applicable to every organization having 10 or more person.

I am agree with Simita & Harish
I think 2 things are important.
Act talks on employee ( not male/female ) so if your organisation have 10 or more employees you have to have define policy. Second thing is awareness among employees about the legal part of policy & to help your people to Respect WOMAN because though you may not have any category of female employee but female guest/visitors may come in your organisation and considering your legal responsibility and image of organisation its MUST to DO.

You may not have female employees but you could have female visitors. As such design policy as per the Act & rules made thereunder.
Will be able to design legally correct policy & impart training to ICC members about conducting enquiry on received complaint.
