If a staff informing to the department head / admin through email that proceeding on leave to home town for 10 days. Is this is valid where a company has no HR / Leave Policy / Application Procedure. Staff is availing leave due to office politics / frustration by department head. Staff is ready to face the circumstances to leave the job also. One Month Salary also due to pay to the staff, as company is not complying the labor laws / payment of wages act. Always pays the salary for the last month in following 15th to 20th. What will be the the risk factor towards staff and company.

The professional approach is getting the leave approved by the line manager and not just informing the Line Manager. With regards to risk factor of leaving the organization please refer the termination clause of your company.

Informing the company, not actually taking an approval or even giving advance notice is definitely going to sit badly. The departmental head is very much in his rights to terminate the employee (since they are not following the labour laws, i doubt if he will bother to have a departmental enquiry, etc.)
whether you can fight it, depends on the appointment letter, standing orders, state rules, etc which we are not aware.
But the company having your 1 months pay definitely puts them at a stronger positing as you will struggle to get it from them now.

If in a company there is no standing order, no HR / HR policy, and the department head treat staff as chattel at authority's dispensation. Without the consent of director or written authority tells one of the staff to move to site and take over. But the job is not as per the staff's profile. The staff refused to do the low profile work. The departmental head verbally tells, if not then leave the job. The staff has been working in the company for the last around four years. These are due to lack of managing of departmental head who himself doing the office politics take unwarranted personal benefit with the help of very junior staff who has to obey the departmental head.
So how these can be treated as per law concern.

Applying for leave through E-mail is valid in case of any unforeseen consequences.
As per the Act, the Wage period will be from 1st to 30th and they have to calculate and pay on or before 7th or 10th in subsequent month.
The Employer has to follow.

Hai members, now a days leave is not right. Leave can avail on prior sanction or intimation. Taking leave is not solution for problems. Problems should solve on appropriate plat form.
