Hi Sir/Madam,
I have a little query about bonus "I am working in a Manufacturing company since 10-oct-2010 ,my last working date in this company is 7th march,2013 .my company use to give bonus on Depawali timing ,sir can i go for claiming my bonus ? is there any labour act like "payment of bonus Act,1965 ."? "

As it is not a statutory bonus hence you can not claim the same and there is no act related to deewali bonus.

Sir, I am not talking about only diwali bonus ..i am talking about the bonus which employee gets normally from company if salary is below 10001-Per month.

Dear Anubhav,
As per my knowledge, all the payments due are to be made at the time of the Full and Final Settlement. Kindly check with your HR, whether your Full & Final Payment Cheque does include your Bonus Payment or not.

If the financial yr of your Co ends by march and your salary is not more rhan Rs 10000/pm,and if you have worked for at least 30 days in the y/e 2012-13 then you will get bonus as per Payment of Bonus Act 1965.

i fully agree with Mr. govind singhnegi, but will like to add one point to his answer on the payment of bonus on company profitability, if any company is 5 years and in loss then also the company will have to pay bonus after the completion of 5 years. and if the company is profitable from the very 1st year then bonus is mandatory from the 1st year itself.
Also it will depend on the company policy of calculating the bonus, as per act it will be calculated on (Rs. 3500 *no. days presented)/no. of days in a year.

The time limit for paying bonus under payment of Bonus Act is 8 months from the close of accounting year and not 9 months as posted by Mr Govindsingh Negi . ( Sec 19(b) ) Varghese Mathew 9961266966

Yes, Mr. Varghese Mathew is correct in this regard. i.e it is atatutory to pay bonus within 30th of November after completion of previous financial year. Employer cannot delay upto final settlement, if it is done after November.
