Please shift the victim immediately to the nearest hospital / government hospital.
Inform the same to your Management about the full details.
Inform the same to the Police Station in your jurisdiction.
Infom the same to Labour Commissioner Officer (Contract Labour License Issuing Authority) through normal letter and ask them to give the details about the compensation to be paid to the victim/family of victim, BOCW Registering Authority in specified form in BOCW Rules.
Please submit the Compensation amount through Bank Draft to the Workmen Compensation Commissioner / Labour Court (as applicable to your state).
In case if the victim died then,
Collect the Age Proof, Family Details Proof, Dependent Certificate for the family members.
Collect the FIR Copy, Panch Nama copy or Inquest report copy, Post Mortem Report copy, Final Investigation Report copy from the Nearest Police Station.
Collect the Hospital Treatment Details (or) Brought Dead Certificate alongwith death declaration by the Doctor from the Hospital.
If cremation is done in the same place, please take the cremation certificate from the crematorium.
Please apply for Death certificate from Municipal authorities along with Death declaration/ BD Certificate and Cremation Certiicate. You will get the Death Certificate from the Municipal authorities.
To claim the PF Dues/Pension amount/EDLI, instruct the family members to open seperate Savings Account, and ask them submit the xerox copy of first page of pass book and their identity proof.
Please fill the PF Related forms Form 10D and Form 20 and submit the same to authorities alongwith Form 5 and Form 10 details.
Now you apply for Insurance claim.
Fill the Insurance claim form
add the following documents
(a) Death Certificate Xerox Copy duly notorized.
(b) Medical Expenses billwise details, original reports and original bills
(c) Receipt of Compensation Paid to the family through WC Commissioner/Labour Court. After Paying the compensation amount, the authorities will issue a receipt for the same. Please attach the original or xerox duly notorised.
(d) Date of Birth Certificate of the Victim as Age Proof.
(e) Family Details/Dependent Details of the Deceased.
(f) Panch Nama / Inquest Report (If the same is in vernacular language, please attach the same in english translation also)
(g) FIR (If the same is in vernacular language, please attach the same in english translation also)
(h) PM Report (If the same is in vernacular language, please attach the same in english translation also).
(i) Translation of Death Certificate in English duly notorized.
On Humanitarian Grounds please extend full support to the family of the deceased worker.
