Dear Thakur
The Factories Act 1948 provides for only weekly holidys and compensatory holidays which are paid but there rae no holidyas other than this. However an employer can allow holidays under contract of service or by way of an agreement.

There are three compulsory holidays - 26th January (Republic Day); 15th August (Independence Day) and 2nd October (Gandhi Jayanti). Any other holiday differs from state-to-state and industry to industry; there is a list of holidays that is applicable to only banks and there is another list that is applicable to factories.

Dear Sanjeev
I have not come across any provision under the Factories Act which declares 26th January, 15th August and 2nd October as compulsory paid holidays.. Probably it escaped my notice. kindly specify the said provisions for my information.

Dear Sir,
I would like to clarify that the weekly off days/compensatory days are general paid holidays.
Besides above, National & Festival Holidays Act declares 8 holidays as National and Festival
holidays to the employees as paid holidays in a year.

Saikumar,
In my response to the above query, I didn't gave any reference of Factories Act, 1948. All I said was that there are THREE holidays that are compulsory (26th January, 15th August and 2nd October) for all the companies and industries across India. Other holidays are choosen by companies based on state of their operations. In fact, if one company is having offices in different states, they can choose different list of holidays.
Thanks,
Sanjeev

Dear Sanjeev
What I understand after reading Mr.Guru Murthy 's reply is that these three national holidays are compulsory under National and Festival Holidays Act. I tried to asceratin whether this is a state Act or Central Act. It appears to be a state Actof respective states. If so,we do not have similar Act in Maharashtra. Nevertheless, thanks to you and Mr.Guru Murthy for this useful update.

Hi all
Could you clarify if it is compulsory for companies to give employees 2 days off a week? Also, if an employee works on a weekly off for part of the day, what is the compensation to be provided?
Thanks.

Hi!
There is a difference between a leave, weekly off and Paid Holiday.
Weekly off is something which every employee gets as his right for the work done during the week, Leaves is something which is right of employee but he can take it as per his wish and when required this is either a Casual Leave, Sick Leave or Privilege Leave as per the company structure.
Coming to Paid Holidays, Every company offers paid leave to its employee on various occasions depending on the festivals of the States so it varies according to the states, but there are three compulsory holidays or statutory holidays by the Government of India these are 26th January, 15th August & 2nd October according to which any factory or establishment must remain close irrespective of the law under which it is covered. In state of Maharashtra since Maharashtra Day is on 1st May it is made as statutory holiday and the institutes i.e. factories or establishments are required to be kept close.
Incase the establishment cannot be kept closed the employees or the workers are required to pay 2 times of their pay for that particular day in addition to what he would have got for normal day working. i.e The worker if he is earning say Rs. 100 for that particular day he would get Rs. 100 his daily pay + additional Rs. 200 as his extra pay or overtime for the work done or it can be compensated with two compensatory off's as per the company
