I am shalaka patade. Have a query regarding ESI applicability . Please guide me for the same.
We are a subsidiary of one Company in Agri Business. We are in seeds business. Our office at Ahmedabad is registered under The Shops and Establishments Act, wherein 14 persons are employed. These 14 persons include sales and marketing employees.
We have a farm at Bangalore wherein research work is carried on. 7 employees are working at Bangalore.
2 employees at Ahmedabad and 7 at Bangalore are paid salary less than Rs.15000/- per month.
Is ESI Act applicable to us?

Dear Shalaka,
If all the person working at different locations & gets salary through same ( Single ) company then all employees will be clubbed together for the ESI strength eligibility ( Which is minimum 20 )
If above clarification suits to your situation then if irrespective of members of those getting salary salary less than 15000 your establishment would be covered under ESI Act.

Any of the establishment, where 20 or more person employed either on one location or different locations will be covered under the provisions of ESI Act. Now the ESI Authorities have issued a notification through which ESI Authorities are covering the establishment where 10 or more persons are employed for wages/salary not salary ceiling for the application of ESI Act.
You are requested to kindly check it with your Area ESI Inspector whether they are covering the establishment on the basis of Act or on the basis of new Notification.
