Hello Friends,
Am into Pvt Ltd company. I want to know that is any space available in any or all of them PF, ESIT, PT law that company dosent deduct from employe and pays them into their salary. Can a company do this.
Pls reply immediately its urgent.

Hi Rohit,
As per the salary slab Company is bound to be complient with all the Statutory requirements. To avoid ESI deduction Company has to fix minimum gross salary of Rs. 10,000/- per month. You can avoid PF deductions if employee's basic is more than Rs. 6,000/-. But you can not avoid Professional Tax.

Well i got your point but kindly find any more option or space in legal books coz at present am in little crisis so as to avoid the problem of PF Esic and PT.
well i can continue with PT but PF & esic are huge problem with me, kindly find some way.

Hi! Rohit
You can do one thing increase your gross by 10100/- which would avoid the ESI part and your basic should be more than 6500/- in that case you neednot pay the PF also. But PT is sumthing which cannot be avoided.
The above would completely depend on the employees salary if the gross is less than 10100/- and basic less than 6500/- then u cannot avoid it.

Hi Rohit,
PF also can not be avoided if the deduction is currently being made in current co. Now even if your basic goes beyond Rs. 6500/-, PF deduction can not be stopped. Once the deduction is started you can not stop it.

Until i know once the employees basic is more than Rs 6500/- it becomes optional whether the employee wants the deduction or not. But when it is taken as a component n everyone's PF is deducted despite the basic being more than 6500/- then yes its continous

You can do one thing .i.e you can increase your total salary (gross salary)by more than 10000/- so that u will not be deduct ESI.Maximum salary sealing in the case of PF is 6500/-. So an employee's salary is more than 10000/ - u cannot deduct ESI & PF. but pt is deducted

Hi folks,
Most of the information given so far seem to be in line with the PF regulations. Thanks folks for such an input. However, the Pf contribution made by some firms is based on the gross salary and some contribute on the sum of Basic and DA. There seems a case is pending with Supreme court for its verdict. Could any one throw some light on this matter please?

Dear Franklyne, under section 29 of the act PF contribution shall be calculated on the basis of Basic wages,dearness allowancce and retaining allowance if any. regards RNS
