Hi! Ours is a PvtLtd Company and I would like the retirement age to be 55 years. How do I do that. ALso let me know that snince we have more than 100 employees do we need to get a standing Order done and get the same approved by Labour Commissioner. Rgds Sudhanshu

There is no hard rules to restrict age of superannuation in private companies. So long an employee is fit you can employ him. However, it is better if you fix up age of superannuation common to all employees so that much question of antagonism can be avoided. It can be 58 or 60 and even 70 but it should be common to all. There cannot be any special status to IT companies and are like any other industry or establishment. All matters which are required to be implemented on the ground of natural justice should be implemented by IT firms also. Any establishment which employs 100 or more employees shall frame and get it certified by the an Officer not below the rank of Asst. Labour Commissioner the Standing Orders following the Industria Emplyoment Standing Order Act, 1946. Regards, Madhu.T.K

Please suggest me, one of our worker is attaining age of 58 years in April 2013, as per the date of birth he gave us on employment form, and we don’t have any document regarding his date of birth proof. There is agreements between management and workers but no clause of service is mentioned in it, can we retire him after completion of his 58 years service, he is requesting to continue in service 3 more years .

Hi!
I wish to know if there is any implication if we do not adhere to the age criteria in an organisation or is it mandatory to frame a policy on age limit.
Also, please let me know what do we do on this? Mine is a Pvt Ltd. company employing around 400 employees.
We do not have specified policy / clause on the appointment letter that specifies about the retirement age. Is it mandatory to have it. If yes, can anyone suggest what do we do about this.
