Earned or Paid Leave is credited on account of an employee presence on the duty for a period of time. Where in a Maternity Benefit Act is a social security for a period which is irrespective of actual physical presence from duties. So a women employee will get Earned Leaves during her Maternity Leave too.

While an employee is on maternity leave why should she requires another leave during the same period? And if your question is that whether the maternity leave period of 6 months will account for annual leave next year, then the answer is that the period that a woman employee had spent on maternity leave will be counted as days worked for eligibility for annual leave in the next year. As you know an employee should get 240 days work in order to be eligible for annual leave. For that purpose the maternity leave days will be considered as days worked BUT the number of annual leave that one earns will depend on the days physically present for work, that means, she will not EARN leave for the days she was on maternity leave.
