Hi, In our company we have 30 days notice period . one of our company employee joined recently and worked only 1.5 months. suddenly he came and informed us that he received a better opportunity and wanted to move immediately. We clearly communicated to him that he would need to complete a one-month notice period before leaving; otherwise, we would not be able to process his full and final settlement. However, he absconded within ten days without serving the full 30-days notice period. now he came again and asking to process his f & f . now what we have to do . experts kindly comment

Hi,
Once employee absconded ( after updating that he got a better offer) immediately start the disciplinary process by serving warning letter to his present and permanent address stating that he is not reporting to office in spite of being advised to serve proper notice period as per the terms and conditions of the employment contract. Provide some deadline date and advise him to report to office. Mention that if he fails to report back company will be forced to process termination and in case of termination his full and final settlement will be forfeited.
Now as he is contacting for FFS advise him to serve proper notice period. Educate him that incase of termination during future BGV process he will be provided with actual reason (absconded without information) .

Dear Sathish,
If employee did not served notice period the employer can-
1. Declare as absconder.
2. Decline to issue any experience certificate.
3. Recover amount of salary due for notice period of 1 months (As mentioned in appointment letter 15 days to 3 month)
*Employee can pay the calculated amount for not serving the notice period. Mostly companies are doing the same*
