I have resigned from my job where the company is asking me to serve a notice period of 60 days but I have chosen to work for 34 days. So now the company is not accepting my resignation where I have stated that u can adjust my balance leave and if then also any amount is there to pay I m ready to pay. but they are not accepting now what to do.

So far as the interest of the organization is concerned, the employer happens to be a superior party to the contract of employment. That's why an overriding discretion is vested in the employer either to accept or reject the buy out option of notice period by the employee in the matter of resignation. Whether feigned or real, the employer can exercise his discretion the way he likes as if in the interest of the work of the organization.
Therefore, if the chances of rejection of buy out offer by the employer are more, the only way out for an exiting employee is to plan his exit in such a manner that mostly he serves the entire notice period .

The clause of your appointment applies to you. If there is a clause of buying out option for notice period, you can do so Or otherwise you have to serve notice period time as specified in terms of appointment. While looking for a solution please attach letter of appointment to suggest good for the problems.
