My service with the Private Limited Company is 4 years, 11 months, and 24 days. I joined on 08-June-2015 (DOJ) and left on 02-June-2020 (DOL). Am I eligible for gratuity? Due to the prolonged lockdown and job cuts, can we still receive gratuity benefits?

Gratuity Computation is related to Period ofContinuous Employment as defined in the Act . Kritarth Team 15.5.20

Dear Chinrasu,
You are entitled to gratuity if you have completed at least 4 years and 8 months of continuous service by the date of your intended resignation. The period of lockdown will be considered as part of your duty.

As discussed, my Date of Joining (DOJ) was 08-June-2015, and the Date of Leaving (DOL) was 02-June-2020. I have submitted the Gratuity Request Form on my last day.
Despite frequent emails and calls, I am not receiving a proper response from HR.
Email: No reply from them.
Calls: I was informed that they have a Trust, and the amount needs to be processed from the Trust, which is causing a delay.
It has been 3 months, and I am still receiving the same response. Can someone advise on what steps I can take next?
I am from Sholinganallur, and the company is located in Siruseri, Chennai. To raise a complaint, who should I contact? Please assist me.

As your company management did not reply negatively to you, you may await for some more time and again send a reminder to the company by post (by R.P.A.D) after a reasonable period of time. You may preserve copies of all communications sent by you to your company regarding gratuity payment.
In case of no response from the company, you can approach the Dy. Labour Commissioner, under whose jurisdiction your company is situated. The Dy. Labour Commissioner is the Controlling Authority (CA) under PGA, 1972, along with all relevant documents.
