Security guard's full and final settlement has been done, but he left the company by locking the quarter with his own lock and key. Now, he is saying that he has stitches on his stomach so he will not be able to come for a week. When called after a week, he is saying the stitches are yet to be opened, so he won't be able to come for another week. He is claiming there is a gold ring and precious assets inside the quarter. What should we do?
Dear Rithveek,
After the termination of the contract of employment, the relationship, if any, that subsists between the erstwhile employer and the ex-employee who still holds the possession of the official quarters allotted to him earlier would be that of a landlord and tenant only. So the only remedy available to the employer in such a situation is approaching the Civil Court for eviction. But as a prelude to such legal action, the employer has to give some reasonable time to the ex-employee to vacate the house by sending a notice of eviction by registered post or any other appropriate means.
