I am from the HR department, one of my company employee (Fresher joined as Trainee) which have taken leaves of 3 days just after 25 days after joining, when he not came on 5th day we called him and he has given some false excuses for not coming and not even given a date when he will come to office, now after 13 days he called to his HOD and ask for some more leaves but not confirmed when he is coming. Now other his workmate following him as we have hired a batch from Institute (few of them looking serious in work, and the following rule of Company), so I want to terminate him as per my term and condition we can terminate the offer without notice for continuous absenteeism.

If leave has been granted how can you call it absenteeism?
These 3 days leave were approved or taken w/o permission??
What are the terms and conditions for trainee in your organisation?
You can terminate him only for violation of terms and conditions of offer letter.
Pl give him a written order to join immediately.
If he fails then initiate action as per your offer letter.

Only 3 days permission we gave him for his passport work. after that, he has not informed and when he got a call from the office, his answer is not satishfactory as well he has not confirmed till date on which date he is coming back. meanwhile, he has argued with his HOD, as he left some important work pending and promised to complete after 3 days, 20 days completed today, he called his HOD and said he can't come right now as he has some personal work.
For fresher, our policy is only SL allowed for the first three months of training.

Hello,
You should give him a final warning in written and take his acknowledgement in clear words, when he will be back, and mention clearly frequent leaves are not allowed. If he take this seriously then keep him in team, or else you can terminate on the basis of NO SHOW NO CALL , as per your company policy. I am following the policy for 3 days if candidate is not responding then we treat this as NSNC and can terminate the candidate after considering the facts, and getting information and sending letter too.

Dear Colleague,
Any absence from duty/work is regarded unauthorized if it is availed without permission/intimation or entitlement.
It is not known if the trainee is entitled for any leave that too during short stint after joining.
It seems only 3 days ' leave was allowed and remaining continuous long absence is unauthorized.
Here the basic infirmity is there is nothing on record to prove his absence being unauthorized.
Suggest resort to termination clause in the appointment letter and effect simple termination without reference to absence. Alternatively, call him and ask him to resign and let him go unblemished.
