We have 2 branches of the same company and one branch is covered under pf but the other branch has less than 20 employees. Is there any option that we can exempt smaller branch from pf and esic?

Dear Shepherd, If the company is same then PF & ESIC is applicable though other branch has less employees as Parent company is applicable for PF/ESIC. Thanks, Vineet

Dear Good Shepherd, Please note that once EPF Act is made applicable to main Unit, it automatically applies to all Units across India.The question of independent coverage of a Branch of EPF Covered main unit does not arise.However, for the sake of administration convenience, you can apply for PF Sub Code Number to your Branches, if they are located in different parts of india.The question of having 20 Employees for each Branch for the purpose of Application of EPF Act does not arise.
Same thing holds for ESI also.However, if the Branch is located in "Non Implemented Area" applicability of ESI Act to Branch does not arise as the same is situated in Non Implemented area.
