Dear All, Recently I have joined as a HR Manager in one Company. Previously they used to give salary as usual to the employees whoever in Notice Period also, But now they are asking me to frame Rules and Regulations, structure of Pay (either Basic or HRA etc) for the Employees who are serving in Notice Period. Please help me to frame those Structure of Pay and Rules&Regulations.

Please note that Employees serving Notice period are eligible for salary till the date of Relieving as per Appointment Letter.Salary can not be reduced during Notice period. please let me know why salary has to be reduced during Notice pay?.

In my opinion, there is no scope to reduce the salary even during the notice period. If an employee is serving during the notice period, then he is entitled to get the same salary to which he was entitled to during his normal course of work.

Notice period is served in accordance with the terms of employment . Hence no deduction of salary on account of the same can be made .

Above members has given you reply correctly, my question to you, what is your opinion as a HR Manager is it justifiable to reduce the existing salary when an employee is serving fully i.e. devoting time to complete the task handed over or handover or giving time to get a good candidate and get the work going smoothly, is it a punishment or a reward to him/her for his/her service to your company.
Secondly what if the employee serves notice period only for 1-2 hours daily till his/her notice period, will that suffice. If an employee devotes 8 hours a day they are entitled to get appropriate wages/salary as decided mutually at the time of appointment or increment thereafter till the last day of service of the said employee.

Your question is not clear. So far as I have understood, you meant to say that those employees who are serving notice period should be paid basic salary only and not the allowances? Please confirm.

Normally there should not be any reduction in salary for the notice period service. Since it has considered as a normal working period till the employees last day of working in the establishment. If there is any adjustment with the earned leave accumulated by the employee for the notice period, then it has to be taken as Basic + DA only.
