Dears , I worked in a small startup Pvt.Ltd for 2 years , inspite of repeatedly asking for a Appointment letter they have not given one. I resigned last month , have pending salary as they did not give me the promised salary . When i asked for both of them , they are saying that there is no signed paper for the promised salary so no pending salary, and they wont give the appointment letter either since i have already resigned. they want a simple resignation letter since the letter i sent contained my pending salary and they are holding on to my final month salary too..
any advice ? any thing to help me ?

no one can help you, get your dues and move on. Nothing in this country works towards an individual and you will not have patience, time and money to fight with these kind of people. Find your luck else where. All the Best to you.

How do you prove that what was a promised salary to you? You have no papers or letters to prove that. So there is nothing much that can be done. Give the letter, get your salary on the same day and move on.

If you have any document given to you by your company, please share to appropriately advice. Were they paying salary in cash or in your bank account directly through bank transfer? Were you covered under ESI, PF?

you must be having ,
1.Pay slip showing details of Salary .
2.Any thing in writing from your side to HR Dept.for correct Salary .
3.Any Other communication in writing .
4.ID card
5.P.F ,ESIC .

It is a fact that you have worked with the company. As such the lack of appointment letter need not affect the status of your past employment or the salary that is pending. However, the question of salary promised depends upon the evidence you can muster.
There is no harm in submitting a revised resignation letter if the same has been sought in writing.

Fear not, this forum will guide you thru' in all respects. Tell us little more about your establishment, how many employees, is it a co. or a partnership firm. In which place you are located. What registrations you already obtained.
