There has been an issue regarding referral hiring lately. our company policy goes
"Beside the ex-house job advertisements and keeping the critical nature of our business in mind, the open positions may also be announced In-House by the HR department. Staff can refer the suitable candidates for the vacancy. Staff can not refer their immediate family members, (Parents, Siblings, Spouses and Blood Relatives) those candidates referred by the staff may be contacted directly, and they will be undergoing through the rest of hiring formalities completely."
on of our employee reffered his friend to work in his supervision who was later hired as internee. our CEO did not know that but HR was aware. but when it was disclosed to CEO he recommend to hire SOME ONE EXPERIENCED and release the internee. Once released the internee applied for an opening in some other department and got selected for the post via interview and all. Now our Boss is of the view that our policy is bypassed in this case and he should not have been selected even shortlisted for this.
Please advise how to justify this as an HR Officer.

As per the policy stated above, the person hired is outside the given parameters for whom the person can recommend. So he can very well if fits in the catogery can be hired.
Now You will have to tell us as to the exact reason the boss is saying that the policy has been bypassed or he is reffering to some other policy, where an employee earlier hired and then releived cannot be rehired.

Thank you Ashutosh for response. As mentioned earlier on too, the person was working as an internee for the first time in our company and there is no other policy in contrast with this decision. Its just our Boss may be misunderstood and thought of this clause as anti nepotism policy. Which again does not prohibit this internee to be rehired.
I am trying to explain the situation to upper management and feeling very much anxious due to confusion on all ends.

In addition to what Ashutosh Thakre mentioned "..........the exact reason the boss is saying that the policy has been bypassed......", the very fact that CEO wanted someone experienced to be hired points to the lack of clarity while deciding/freezing the JD. On what basis was the internee hired?
W.r.t. your line "Once released the internee applied for an opening in some other department and got selected......", did he get selected AGAIN thru the Referral Hiring Scheme or directly? MAYBE this is what your CEO is referring to?

am not sure of the EXACT reason but what he mentioned is keeping information from him and not disclosing the fact that internee is being supervised by his friend / acquaintance. the second time hiring is done purely following the standard procedure while his ex boss is working in the same company. am not sure if it comes under referral hiring . . . its complicated

Here this candidate was released only at the behest of the CEO in the first instance. When he applied again for a different post in the same organisation his candidature should not have been taken like the others. Should have been brought to the bosses attention before the final selection. Here more than policies and procedures there is also another element, that need to be considered while taking decisions.
