Navigating Absence and Notice Periods: Addressing Illness-Related Resignations - CiteHR

I had to leave my previous employer without serving the required notice period of 3 months due to illness. I was unable to perform my duties, so I sent them a letter of resignation along with a doctor's prescription. Now they are not paying me last month's salary because I didn't give them the notice period.

Notice Period and Salary Deduction

I signed the appointment letter where they mentioned that if you want to leave or resign from the job before completing 1 year of service, you would be required to give a notice of a minimum of 3 months to the company, or the equivalent of 3 months' salary would be compensated, deducted, or claimed from your dues.

What should I do?

If your reason was genuine, then why did you abscond? If the company has deducted your one-month salary, then I don't blame the company; they are right on their part. Remember, absconding is not ethical; it's like breaking the trust of the company. If you want an experience letter and a relieving letter, then contact the HR department of your company, complete all necessary documentation, and pay the two months' notice pay. Sickness can't be a reason for absconding. Now, it's up to you what you want to do next?
