Hi team,
i have resigned from my company on 20th May 2014 and my last working day will be 19th June 2014.
Now my HR told me that this current months salary (MAY) which we get on 10th of every month will go on hold and will be released after FnF settelment.
I want to know that is this correct?

Musak - The FnF is the Full and Final settlement and this is usually the process that is followed for exits. Some companies may , dependent on their process and payroll cycle, offer the salary and then release arrears in the FnF cycle but either is not unlawful.
Relax, the FNF will contain all details and you shall get the salary credited with leave encashments, etc and after deducting of the IT component.

Dear Musak,
As rightly said by my friend "Talentsocerer", this is a part of F&F process. The reason companies do not pay salaries to their exit employees for the last working month is to make sure that the employee serves their full notice period.
There have cases, where employees after getting their stop coming to work and then after their official last working day they come back to collect their relieving letter. In order to avoid such confusions and to ensure proper handover and relieving, companies have opted for this process.
You will get your salary for the month of May (Full month) and June (For 16 days) in your full and final settlement alongwith your leave encashment(if applicable), Gratuity (if applicable), LTA & Medical.
Hope this clears your doubt in detail.

Dear, Ankit Chaturvedi je, Please clarify about june (For 16 days) salary in that matter....

Dear Rishirajmishra24,
I would like to clear your doubt with an example:
Example: If an employee has put down his papers on 15th of June and is serving his 2 months notice period, then the employee is paid the salary for the entire month of June whereas July's salary and the salary of September (from 1 to 15) will be paid during his full and final settlement.
This is done to make sure that the employee serves his entire notice period and there is proper handing over and delegation of activities.

Dear citehr members.
This practice is followed in many Cos. to ensure that the leaving employee serve notice period, handover all in his possession and handover charge of his work to another person. The employee has to obtain & produce a NO DUE CERTIFICATE / CLEARANCE CERTIFICATE from designated HODs to ensure that he does not owe anything & all debit/credit is accounted to arrange / prepare his FnF Settlment & relieving/ service letter. As rightly said by Ankit Chaturvedi; if he is paid, he may chose to join new Co. without serving notice period ; leading to problem for his Dept.,and also to settle & relieve for HR Dept.

I am of different opinion on this regards. The salary of the month has to be paid regularly as per company norms but apart from Salary i.e. Leave Encashment, Bonus, Gratuity etc can be paid at the time of full and final settlement.
Most of the companies follow as per the above views mentioned by forum members which is a wrong practice. Many employee are not in a position to save money from their earnings, so in that case you (HR)/employer is penalizing their employee for leaving the company, which should not happen. By stopping the monthly earning/salary one is stopping the livelihood of that employee.
I am sorry if I sound wrong

Sub: Resignation & Salary.

===================

With regard to the comments of Shri Saji, I may add that there cannot be hard & fast rule for HR Person when it comes to the livelihood of a fellow employee. Situation vary from case to case. for example: some companies on selecting a person for appointment; gives one month;s time to join after receipt of offer letter or Apptt.Advice to enable him to resign, serve notice period in the existing Co. & join new Co. But; some employees, to get the higher pay in the new Co. will resign & run away without serving notice period & without handing over Co.materials in his possession; putting his Dept. & HR into trouble. Some HOD permits his employees to take leave2-3 days to go & check facilities at new place when his staff is appointed in another Co., Though some employees adhere to the notice period & serve fully till alternative arrangement is made, the HODs allow 2-3 days leave to go to his new place to select his house etc., since all are human being & even that HOD also may chose to leave the Company one day; when he gets a better job & pay. Uniform Policy of Insistance of serving one month notice period is required and also; stopping salary to club it with F&F settlment is also a practice since most relieving in case of resignation will be at odd period when HR & Accounts will be engaged with other works. Where salary cannot be paid, Advances are given to help leaving employee. Thus, it depends; if the employee is a good worker, served notice period, HR has made F&F settlment on the last working day itself; if the employee submits No Due/Clearnance Certificate on the last working day itself. Hope; members may agree; Thanks c.neyimkhan
