I am working for an Insurance broker as VP- operations, Post my joining I was told that I will be doing sales, I have joined this organisation in month of September-13, I have not been given my salary for the month of December-13 as a result for non performance & addition to my mental agony I received a call from one customer stating that they have received a mail from my employer that I am no longer working with the company.
I was not informed about the same by my employer.
Request you to kindly guide on the same, should i send a legal notice to my employer seeking reason on holding back my salary?

Before sending the Legal notice, you discuss the matter with the HR/Director with regards to the salary put on hold. Apart from that you just got a call from the customer, you don't have any documents to prove it even in the court of law. Do your paperwork/homework for legality, just assuming things out or verbal communication does not fetch out any amicable solutions. Would appreciate to sort the matter out amicably across the table.

My salary was put on hold by my Director giving me the reason of non performance, I am recruited for managing back office operations of the company.
My director had put a mail to my customer stating that she has got to know from the market sources that I have quit my organisation, which was a surprise to me. I have been barred from coming to office & I have still not resigned from my organisation, the customer has forwarded me the mail which he has received from my Director.
I tried to discuss my salary matter with my Director she told me she will release my salary once she receives the Insurance commission from the insurance companies for the policies sold, whereas there is no where mentioned in my appointment letter that I will be getting my salary basis my performance.
As per the IRDA guidelines an licensed individual can solicit the insurance policies.

Even in my earlier post I have asked to gather the evidence/documents before proceeding the legal suit. I would once again request you to send a detailed letter mentioning the episode and wait for the reply, in the meantime you can consult the lawyer and get the advice to how to go about it. See the reason behind telling to sort out the matter amicably is to avoid the long process of the court, wherein you will be required to attend the case every now and then
