Dear All,
Help required in case of maternity leaves
Three of my query are
1. If the organization has started its operation in August 2013, and an employee applies for the maternity leave, her expected date of delivery shall be in February. According to Maternity Act 1961,80 days in the last 12 months. but the organization has just completed four months of operation
2. Does Maternity leave include week offs? intermittent holidays?
3. what is meant by 80 days of continuous service? does it include sanctioned leaves? if i am correct leave without pay shall not be included

as per Esi act act. the contribution of the treatment eligibility after 90 days . u said u r company has started 4 months back then the company had completed 120 days then she might have completed the 90 days, so she is eligible if she complete 90 days of contribution

Hi, Thanks Srihari, But the employee does not come under ESIC act. She has completed 80 days in the organization, and Organization is 4 months old. Please throw some light on medical bonus, our organization is not providing any Mediclaim facility. Also Employee does not fall under ESIC slab

Please read the amended Maternity Benefit Act which is as below with regards to your query related Medical Bonus to employees. Hope will clear your doubts.
“8. (1) Every woman entitled to maternity benefit under this Act shall also be
entitled to receive from her employer a medical bonus of one thousand rupees, if no
pre-natal confinement and post-natal care is provided for by the employer free of
charge.
