Hi,
I was working with India's second largest IT company. I joined the company in February 2012 and signed a bond on notarized papers for working with same company for 18 months. Due to some personal issues, I had to come to my home in February 2013. Unfortunately I was not able to make my way back to resume my services and I resigned from my job writing a mail to the company HR in march 2013.
Few days ago, I received a notice from my company's legal firm stating that I have to pay them a sum of 2.20 Lacs or else they will take a legal action.
I am not employed anywhere after my previous job and there is no way that I can pay such a big amount. I dont mind from getting black listed also as I am no more into the field now.
Please answer few of my questions.
1. What all legal actions can be taken against me?
2. Should I reply to these notices? If yes, then how? These notices come to my home from private courier service & not registered posts

it is a commitment done voluntarily by you, before breaking the bond you should have thought on the consequences in case of break. Now no option except to reach a compromise between company thru legal process. please contact a lawyer at your place and seek advise before you act. Now a days all companies feels that bond breach is common in employees and hence they are trying to fix leaving employees in middle of commitment.

Hi,
Did the employer put you on a training session initially when you joined? If so, how long was that and in which platform were you been trained. You have mentioned that you did sign a bond with your last employer. Can you let us know the subject matter for which the bond was signed, apart from the period?

Yes i have been trained by my employer on business intelligence stream for 6 months... After that i served in production unit also for 6 months...
There were some serious personal issues back at my home which forced me to leave my job and unfortunately leave IT field also...
Its been 8 months now since i left my job and I am still unemployed with no source of income.. please suggest me what should i do...

Hi Mahesh,
Breaking Bond is a serious issue. Why the Companies are taking Bond, because, Companies are spending a lot for their employees' training and the benefit of training must accrue to the Company. That was why, against 6 months training, they insisted for 18 months service from you.
Any way, if you can prove that you left the services because of serious personal issue back home and not for joining any other Company, and you are still unemployed for the last ......... months and do not indend to join any employment in the near future, etc.etc., you may be able to get some relief. You can also give undertaking that if at all you join any IT Company in future, that will certainly be your ex-employer for the remaining bond period, so that the legal proceedings can be avoided.
Otherwise, the Company will certainly proceed with the recovery suit, as this will be a precedent to other such bonded employees.

Hi..
Thanks for your suggestion. I also want to tell you that I wrote a mail to HR regarding withdrawal of my resignation and join back my services but they did not reply.
I want you to suggest me that should I wait for any legal notice from court to come OR should I reply to the company before that?
