i have been given an offer by my new company to join in 8 weeks. however, their offer contains a notice period of 12 weeks.
The notice period in my present company changed from 8 to 12 weeks after i got the offer & they are in no mood to waive any part of it.
i have updated the new company of the change in policy & that i can join only 4 weeks later than initially decided.
To reassure them i have shared my resignation letter which mentions the last working date which is less than 8 weeks.
The new company has told me that they cannot wait more than 8 weeks. Then said will get back in a day or two.
my question is, do you think the new company might withdraw the offer?
should i withdraw my resignation letter and play safe.
My current employer would like to me stay back.

The decision of withdrawing offer completely lies on how crucial is the position & the new employer will like it to be closed. But if it is a matter of day or two you should wait for the new company's decision & act accordingly. However what do you mean when you say - "To reassure them i have shared my resignation letter which mentions the last working date which is less than 8 weeks." Why is this conflict between what is said & what is mentioned about relieving.
Was the new policy introduced after your resignation? If yes & also, if you weigh the new opportunity better then your current status you can very well try convince the management to go by old policy of 8 weeks. Suggest wait for the new employer to give their decision & act accordingly.

You should realise the expression of the new employer (NE) awaiting for you to a period which is lengthier (8 weeks) and much to an extent of another 4 weeks... What a gag..!! is what exactly running in the wits of the NE.

Well, in the note of your resignation... have you seen the current market situation?

The job market changes quickly these days, and you never know when you may need to request a reference from your current employer; therefore, you should never use your resignation letter circulated to the NE/ anyother out of your company as it is against your integrity before leaving the organization.

Since, you've made up to your resigning the current place, await the comeback of the NE (as discussed). The other way is; see if you can manage to explain your current ones (try pay a month tact). Try the best to ENDORSE your situation in the best possible way to hold control till you next hear from the NE.

[DONT BE HASTY] -- The moment you are made aware of the decision from 'em, put your decision right.

Thank you Sharmila for the prompt response. This does help. However, i dont understand the above part. This company too has a 3 month notice period. I had never committed to joining earlier than 8 weeks.
i am into week one, am being honest. am sure after 8 weeks calling them up & updating that i will join in another 4 weeks would be worse right?
in my domain of work, all companies now have moved to 3 months notice period.

inspite of me updating them on 8 weeks of notice period the new company made me an offer with joining date of less than 6 weeks. in my acceptance letter i did not commit to them on the joining date & mentioned that i would confirm it once i have a talk with my boss.

If all the companies in your domain had bespoke/made to order with 3 months of notice period, you've the liberty to speak out the present situation and so will the next employer be available to be au fait with it. I'm sure if your employer had selected you -- they must have really thought you to be the best suited candidate and I deem to say you may expect some affirmative response from them.

It does! Joining in less than 8 weeks is complete no-no. You must ensure to abide by your current employer's policy. World is too small for us to need them whom we met in past. I hope you understand.
For sure if the new employer is ready to await 8 weeks you can ask your current employer to go by that. But again, only if the policy was not withdrawn before your resignation. Here even the clause in appointment letter would not help. A lot depends on what terms you share with your reporting boss and how many projects are you working on. Also, how many years have you been serving there. Hope analyzing & sharing this will help.

Methinks if your NE really need you in their ranks extending the joining time shouldn't be a problem for them. However it may help you if you would meet the concerned both at PE & NE and explain them your position personally. "Part as friends" always helps. The outcome also give you a clear idea "what next" for you. All the best.

to the new company i have always been treading the line of completing the notice period of which was 8 weeks, anything earlier would be a the discretion of my current employer.
unfortunately it changed to 12 weeks something my boss doesn't want to waive because he is not my best friend and is short of people right now.
I have been with the organisation for 5 years till now. Hope this information helps
