Hi All,
I\'m making some amendments in my current leave policy. Some employees of our company take leave without information. So I introduce a new rule.
Leave Without Information will be considered as LWP.
•In case of Balance Leave, Balance leave will be lapse & 1 day LWP.
•In case of no Balance Leave, 2 days salary will be deducted.
(It is only implemented for those who didn\'t inform whole day, because we know emergency also occurs sometime)
So plz let me know can we implement this rule in our company. Because some people are saying it is illegal.

As far as I can see & know, the "Balance leave will be lapse" will bring you serious problems.
You can't nullify ALL the Balance leaves for such reasons. Counting the 'Leave Without Information' as LWP is OK, though your current Leave Policy must be having the Prior Approval is needed to avail leaves clause--except emergency situations.
Reg the Legal aspects, suggest wait for other members to respond with the appropriate Legal Acts references.

I got it--looks like I misunderstood your posting earlier.
Coming to 'what to do', suggest go ONLY for 1 LWP for 1 LWI--that way you won't have resistance to begin with. "1 for 1" policy is BOTH fair & realistic I guess.
If >1 day leave is deducted for 1 LWI, you COULD be inviting unnecessary motives by the employees. While solving one problem, you MAY create another--hope you get the point.
If this doesn't give results, then, maybe later, you can increase to >1 day.

Hence, anyone on leave without information is considered as NCNS (No call No show) and due to this, it impact their salary and incentives. NCNS should not be tolerated, otherwise can lead to major impact on the process. Everyone want leave, less work and more pay. It is impossible to track the valid reason behind the leave. Hence, to discourage such practice, it must be tackle with harsh measure which realizes the employee before availing such leaves.
Any leave which is not approved by the supervisor/manager also considered as NCNS.
