am working in tata enterprise in mumbai.
some day befor we got organization restructure chart unfortunately my name is not there in the list.
After one week I got termination letter saying that my performance is not satisfactory. Company releaving you on immediate effect
need your help.

Mr. Ashraf,
Without giving notice period the employer cannot terminate the employees who are working in the organisation. There are certain rules for termination.
First of all give us full details (your doj, wether you are confirmed or on probation) so that we can help you.

Well seems to me there is certainly something which is not shared by you and missing in your query. I request you to please let us know so that you can get good and appropriate solution of your problem.
Second, No employer can terminate any employee on immediate with just issuing a letter saying a reason of nonperformance. There is a procedure of these actions where employer has to issue a letter to employee regarding his/her poor performance first. If the performance given by employee ever after the notice/warning letter found unsatisfactory employer can be asked to leave with a certain notice period according to the terms & conditions of appointment letter what employee and employer has agreed on. Immediate termination cannot take place on just to observe poor performance of any employee.
