Hello Seniors
I am working with an IT company at Hyderabad.My company has made new rule regarding the PF eligibility.The rule is an employee is only eligible for PF when he/she completes one year in the company.
I want to know is this rule is being followed in all companies. Can i claim my PF amount at the time of resignation?????

Dear Sinha,
Your Present company is cutting your PF are you confirm about that,you can claim your PF account.When you leave the organisation you can sign the forms submit to Hr dept they will make follow up with PF office
The company will hold your form for 60 days then they will send to PF office,but in your case you can check with your firm.this is the proceedure.

The thing is that they have not open the PF account for any of the employees. But they are deducting the PF amount.
In that case I can claim for PF on not.Or I have to follow the rules made by him because I have not completed one year in this company.
Guide me...

In my view your company may be doing some mistake that 1 is..they may not open the PF account...2nd one is they already had an account but they are not paying them. There is no specific rule for PF saying that after one year completion only that particular employee will be eligible for PF. They are trying to escape from paying the PF amount to you.
My suggestion is you please approach you HR and ask him/her in a polite manner about this issue. Then defiantly she/he can help you and make you understand. If they are paying your PF contribution to PF office..? then you ask them acknowledgement and and your PF number. If you HR doesnt share the information..? you approach your seniors( Who completed 1 year in that org.) whether they have PF numbers and getting acknowledgement every month or not...

My company is a start-up company & I am working as a HR Executive.No one in this company has completed one year & there is no HR Manager. The company's head is taking care of all the responsibilities. I have talked to him many times regarding the PF account
& he said we will open later on.That time he said I will return the PF amount but few days back he implemented this new rule.
Is the rule made by him is legal???????
What action I can take??????

Dear Babu .P,
The same case is with organisation where i m handling HR Dept. This is fabric manufacturing company, the PF procedure is not proper over here. PF benefit is not provided to all employees, if any employee want to avail PF benefit then organisation deducts both employee & employer contribution from their monthly salary and provides the amount after leaving the organisation. Is this practice authentic. Kindly guide.....

You have any proof that u r company is deduting your PF,If no there you have to check with labour Department,Regarding pf Issue you can have discussion with the Labour Department were u are handling these activities.u can take action against your company.

Hello Sir, Please confurm me what about deduction of pf in fix payment i.e soppose fix payment 10000.00 per month than what about calculation of pf.

if you have 20 or more employees than you should take Provident fund code from P F authorities.
secondly deducting PF and not depositing with authorites is a criminal offence under section 405 of indian penal code ie criminal breach of trust.
please show copy of this section to your employer.
