I m executive HR in organisation.
One of our employee is joined on 01-April-2007 and he resigns from the job and he relieved on 07-March-2012. so he completed 4 years and 260 days in 5th year.
Is he eligible for the gratuity?

eligibility of gratuity is if a person worked for any organisation with 4 year completed + 240 days ( in fifth year) is entitled for gratuity.

Below is the extract of the act, Also The act defines the meaning of continous service,therfore all in all the Five years would mean the 4 years + completion of 240 working days in the fifth year.
(1) Gratuity shall be payable to an employee on the termination of his employment after he has rendered continuous service for not less than five years, - (a) on his superannuation, or
(b) on his retirement or resignation, or
(c) on his death or disablement due to accident or disease : Provided that the completion of continuous service of five years shall not be necessary where the termination of the employment of any employee is due to death or disablement :

from the day 1 of joining doesnt matter about confirmation. any employee who joins newly will be on probation for 3 - 6 months and get confirmed. It is similar to ESI / PF.
