Dear Kumar Sir,
the establishment has decided to shut down the business . To generate a new code they have to deposit 6 months advance contribution but they only have liability of 2 months . so isn't it possible that they show that they have outsourced the business to third party onto which they deposit the ESIC contribution.

OK let me be the stupid one.
do not apply for the ESIC code rather tell your local office manager or inspector to make assessment of your company. This way you will not have to bear the 6 month advance payment because the contribution will be give after the generation of the ESIC Code.
If your company is deciding to shut down then apply for the surrender of ESIC Code.
Now the other way as mentioned by above your contribution will be refunded if the company shuts down, i.e, excess payment will given back to the employer or the company.
Stay Cool,

Dear,
Maitry
ESIC Pehchan Cards are mandate and it will be valid till life time. Ask your company to provide you a TIC then you need to visit to your ESIC BO for snaps for the biometric card. If your company denies to do the same do make a complain to your BO inspector or to RO complains Dept. Then you watch the show dear.......

Dear Sir, It is not good method. In case of any untoward incidence, it will be a great problem. Please take ESI Code and remit in your account only. D.Gurumurthy HR/IR Consultant

Dear sir
Even if the job is outsourced by proper doc and awarding contract, changing rolls of workmen on to the new contract who has ESIC code, it is the responsibility of principal employer to obtai ESIC code. It is better you obtain the code.
