The following questions were asked to one of my friends during campus recruitment.

I would be more than thankful if anyone can answer the same, justifying the reason behind the answer. (I could not find the answer)

Q- What section under Factories Act cannot be amended

Q-What should be the distance of a liquor shop from a workshop (I was told 250 meters, but again do not know which act, which section)

Q-Do service providers need to take a contractor’s license (My answer- Service providers should take contractor's license, provided they contribute to the the cause and the result of the establishment concerned. As a matter of fact, even the sub-contractors are supposed to take a contractor's license, correct me, if i am wrong)

Q- Does CLRA Act apply in software industries

Q- Can teachers of an institute form a trade union. (My answer- No, because an institute does not comes into the purview of the definition of the trade union, as the institute does not regulates the relation between the employees and employers.correct me again, if i am wrong)

Though this is very old post, I saw it today only for the first time. It is confusing to see there are not replies or comments on this.
There is nothing in the F.Act which can not be amended by Parliament of India which is Supreme Law making body.
Liquor shop distance- I have no idea.
Service providers, I do not know exactly but I think it will depend up on the type of service one is providing. There are certain services which are listed in the Contract Labor Abolition Act.
CLRA would apply to Software industry. There is no bar.
Any 7 employees coming together can form a Trade Union,Teachers can. We have huge Unions of teachers at all levels- schools, colleges and so on.

Q-Do service providers need to take a contractor’s license :
I feel it will depend upon kind of services service provider is required to provide. In case service providers' employees or representatives are required to work in principals office or factory then service provider must take license under CLRA Act.

As per the law, Basic + DA should design as per below
Unskilled labours - 5000 and below
semi skilled labours - 5000 to 12000
skilled labours - 12000 and above

  • Kindly confirm under which law and under which section such slabs of basic + da are prescribed ?
  • As per my knowledge there is no such law prescribing slabs or break up of salary. There is only law prescribing minimum wages known as Minimum Wages Act.
