I have an employee of mine, who dint serve notice period and absconded from services. If the employee return back after 2 months and asks for PF, As a HR of the company whats my role ?? Do we need to process the PF forms or can we hold it since the employee moved out in a informal manner ? Notice period and other details are mentioned in offer letter, yet the employee dint adhere to the norms and moved out. Pls provide your inputs.

Taking due permission from senior I am replying to your query.The instance given by you,in that case you can always hold back full and final settlement which can be recovered from the employee but in any instance you can not hold the processing of his PF withdrawal forms.

PF payments are mandatory - you can delay the processing but you cant deny it, if you are thinking of taking revenge on the guy ! But you can always sit with him and give him a piece of your mind the impact his sudden absence made on your organisation like finding quick replacement and training of the new incumbant etc.

Thanks Sundaram & Saurav. Only benefit he has to depend on the company is PF, Since he decided to move out he has taken all his comp off's/leaves. Only few companies make effective back ground verification, so possibility of giving right feedback about him is minimal.
Finally, We cant do anything as a HR of the company, Isnt it ?

you can hold only his relieving letter and full and final payment, if dues are there. but in this smart world people quit when they get their maximum dues clear.. in such cases one or two days salary doesn't affect much to any one.
but in any case PF cannot be stopped as it is deposited in govt. department. and if employer holds the PF form then it can be attested by other gazetted officers and submitted to PF office.
you can only show your disinterest to proceed it bot cannot stop..

We need to know the resone, it may natural emergency !!!! for employee absconding.
We can only hold his releving letter to creat disturbance to his normal routine, as he acted with company.
We should always justified the situation by knowing the facts.

Hi Anoop,
Holding the PF amount of the employee is not a right option, Please don't do. PF is employee’s hard earning money.
But you have a hold on employee’s relieving letter and other FFS which company hold the authorities, you can give a relieving letter with the notes saying that "Employee has resigned and absconded from services"
Being a HR in employee friendly nation, you can't do much. As a HR nothing personal or emotional, Please go ahead with company policy for absconding.
