Dear All,
We are very soon starting a Mall and have employed Contract labour in our establishment. We being the principal employer have not taken the Original RC certificate which is incumbent for employment of contract labour. We have been told that there is an infancy period for employment of contract labour as the mall is still in the completion stage and is yet to commence its operations.
Can any one inform me as to whether such infancy period exists under the principal act and whether we can employ contract labour till the mall is completed without obtaining the RC certificate.

If you want to engage the contract Labour without registration means you should not engage more than 10 (in some states it is 20) contractor workmen in total, for which you will have maintain the Attendance Register, Wages Register, OT Register and Register of Workmen, and other registers required for compliance of statutory obligation.
Please prepare the Application for Registration of Establishment, pay the challan amount (Fee) in respective treasury after consulting the concerned Labour Office and obtain the Registration of Establishment. You have to mention the Contractor's name in the application to whom you are going to engage for supplying the contract workmen.
Whoever contractors' name you have registered in the application only can get the Contract Labour Licence for engaging the manpower in your Mall.
Please get confirmed that are you not required to register under Shops and Commercial Establishment Act.

Dear Bhaskar, Thank u for your advise. Please let me know as to whether there is any infancy period of employing contract labour for new establishment.

You check your State Contract Labour Rules. Even you can download from net also. Check it in google and download.

Dear Member,
There may be difference of opinion on the applicability of the Contract Labour (R&A) Act but we do not find any provision relating to infancy period in this Act.
