I am a software engineer with 3 yrs of exp. I have worked with 3 companies. 3rd one being my current. I have worked there for 1 year. Employee agreement states that employee has to server NP of 60 days, failing which he/she is liable to pay 2 month's salary to the company. I resigned from the company few days back through the email (as my work location and company location are in diff states), i got a call from comp HR saying that i have to server NP of 60 and that they won't give buy-out option. I tried to convince a lot but all in vain! and i can serve 30 days but not 60.
Now as an obvious consequence, i will not be given relieving/experience letter. I have Offer Letter, Appointment Letter, Pay Slips(all). I have got an offer from CMMI Level 4 MNC and they are ready to take me on the basis of prev. appointment letter only (as they have already done my background check and i passed through it).
I need advice on:
1. If nothing works, shall i complete 60 days NP to get relieving/exp letter, and lose new offer from MNC?.
2. Lose relieving/exp letter, and go ahead with new offer.?
3. Are all companies' relieving/exp letters required during passport, visa processing. I mean will i be able to go abroad (at some point time in future) if i don't have some of the relieving/exp letters throughout my career.?
4. I believe there are few companies who ask for ALL the past employment certificates, most of them just need previous employment certs. So say when i will leave the 4th (new offer which i have now) company in future, by that time i will be experience professional with around 5 yrs of work exp. That time will it really matter if i don;t have reliving/exp cert from 3rd comp.(considering that i can manage background check from 3rd comp and i have cleared everything with 4th comp).?
Please i am really stuck, seek valuable advice / thoughts.

I don't see a point why you are thinking so much, you already have an offer in hand so you can proceed further with that, background check is done...and they are ready to hire you, why this dilemma then...
Now coming to the answers of your questions:
# You have said that you have an offer, why worry about this question than??...you can talk it out with your Boss or HR people to relieve you at in 30 days time and pay for the next 30 days..if you can...
# Have already replied, you can take relieving just talk it out...
# I'm not sure about this part...will confirm and come back to you with the answer..
# Its perfectly fine, if you have all other things such as appointment letter, pay slips and copy of resignation letter, i don't think it will create any problems in future..Most companies do a reference and background check these days, you have cleared it already so just prepare for your next venture and get going...but make sure you don't fall in the trap of joining early without an experience letter next time also....
