one of my frnd worked in hospital sector....
Actually monthly the Pf ammount has been deducted from his salary....but the hospital didnt registered in pf office.....
so my question is, can he withdraw the pf ammount....
wat is the procedure....
if the still now its not registered wat will be the procedure....
pls give me a legal Advice....

If your hospital is not registered in pf office then how your pf amount go for you,without registration this is impossible because after making the registration firm can deposit the pf amount
You should go for the authority who is looking after this affairs and consult after that you may go for next

IF you have salary slip showing deduction of PF, then write an application to Labour Officer and PRO at PF office. They will find out the ways. Regards,

Hi sir, if u hav salary which shows that ur pf has been deducted by the employer, you hav to see dat where employr hav registerd off. In delhi or up just forward ur complaint wid salary slip to concernd rpfc as well as labour dept of concernd state, u wil defintly get result. Sunil sharma mob 9910126718

You should first check up with the Hospital, in case you do not get any appropriate reply approach Labour Officer and concerned PF Office with your salary slip (if salary slip is not issued present appointment letter) and lodge a complaint.

If the pf amount is deducted in his salary, i am sure that his employer has already registred with PF CODE,
Then contact with concerned person in ur office for form10 and 19,
fill it properly with ur employer and tell them to submit it to PF office OR u can forward it to ur present employer,
it will take MIN one month time for process.
if ur employer is not registred, u can take a legal action on employer, it will be on ur favor (if all proofs available ), it can also help other employees.

if the hosp. is employing more than 20 employees, it will have to deposit the pf deductions with pf office sooner or later. one can seek withdrawal or transfer into new estt.s account after getting his account no. from office. in case of exempted estt., pf must be lying with the trust of the estt and which will be given by the estt. itself. pl.seek full information from H R Deptt first.

If you have any document to show your PF deduction from your salary then first you ask to concern person in your organisation or hospital,then after you know it is registed or not or on process for register code.In case they have deducted PF amount from you salary and they had not submitted to EPF then you will take a necessary action regarding to them.

Here the question arises if a compay claims to have registered with PF but in reality is not. The employer / company may be deducting the PF and not depositing with EPFO. No written pfoof with employee. On realising this what should be the course of action for cheated employee? Just simple guidelines please.
