One my friends working in a partner ship company his DOJoining 01.08.2010. Company ask him to leave job. In the appointment letter clearly mantioned that

That your services can be terminated by giving three-month notice by either side after confirmation and during the probation period, your services can be terminated without notice.

but up to till date no confirmation letter issued
So I want to know what compensation he can demand from the company Last year 10000/- bonus paid him and last basic salary is 9900/ per month and Gross Salar is 14000/- per month.

Please clear my these question


01. Can he demand Bonus Amount as per last year amount paid ( 10000/-)
02. Can he demand the Three month Gross Salary as Notice

03. 15 Days EL Balance can he demanded the EL incashments on gross salary
04. Can he demand 15 days compensation amount for each service year

Dear sir please calculate and tell me what amount should be payble to Mr Harish my Friends working in Manesar in a manufactring Industries in officail job

he is entitle for the bonus as per bonus act and declared by company
not Rs 10000/- as mentioned by you.
2.he is also entitle for 3 month notice pay irrespective of confirmation letter he got or not.
3.he is entitle for leave encashment due to him
4.retrenchment compensation of 15 days salary for every year service he renendered with company is a matter of dispute because it has to be anlysed wheither individual is covered under industrial dispute act or not.

I have read your questions Mr Malik has suggested you very well and corret answers. Now for the answers you demanded again below are the answers:
1) Last time comapny paid him a bonus amount 10000/ for the year 2008-09 So I want to know also can he demanded same rate or note: No he cannot demand for the same amount. Bonus is given on yearly basis and entirely depends upon the company policy. Some company's pay's the entire bonus while person leaves and some calculates till the person works. So please read terms and conditions on bonus part.
2) Leave encashment is the one day basic salary of the person. So, for example if he has 10 leaves and his basic is 2000 than he will get 20000 as part of his leave encahments.
3) Notice pay- he is eligible for 3 months salary as company asked him to leave and its not a case of Resignation.

I am imran from Lahore pakistan, here i would like to ask that the employee can demand the Bouns if company was in profit, and in appointment letter there is mentioned that One Month Notice, and he will claim one month Basic salary, Earn leave should avail as per law, and earn leave can be encash if there is policy of Leave incashment.
i cote the information as per pakistan labour law, might be there is some difference in India.

it is very difficult to comment on your query because we donot have idea about the bonus act of pakistan.
however i feel one month or three month notice period is a question of contract ie what is written in appointment letter.

Mr. Malik has suggested you very well.
he cant demanded the same rate as company has been provided him last month.
Acc. to bonus act bonus shall be provided minimum 8.33% and Maximum 20%.
First you should check company policy with HR Deptt. and may be it clarify in Appointment Letter that how much bonus company will provide you. After that he can claim his Amount may be it shall be same as last year 10000.
Note- Person Shall not be coverd in Industrial Dispute Act.

Hi,
I am having query regarding an issue that one of my employee met with a accident i.e he was fixing up a nail, it bounced and hit him on the eye which resulted into an urgency of having an operation and after operation he is claiming for giving him some amount , actually the person is working under sub-contractor and we are the contractors already we have done the treatment to him.
His sub-contractor is not showing any interest in this affair and he is demanding that any amount that would be given to him should be given to me .
How could we safely get out of the issue .
